TERM, PAYMENT, ACCOUNT RENEWAL

Term of Service. The term of a person’s or entity’s subscription to the Services commences upon acceptance of these Terms and terminates as set forth herein or in applicable order terms.

Payments and Refunds. Payments must be made according to the billing terms set at purchase or in a service agreement. Refunds are only available as expressly stated in Solskera’s Refund Policy (incorporated by reference). Unless otherwise required by law, all fees are non‑refundable.

Authority. If the subscriber is an entity, the individual registering or purchasing on its behalf represents and warrants that they have authority to bind that entity to these Terms.

REFUND POLICY

Please note that Solskera services are digital in nature. Refund eligibility, if any, is governed by the specific product or service policy stated at the time of purchase.

SECURITY

DDoS Protection. Game servers include always‑on DDoS mitigation on a best‑effort basis. Extremely large or sophisticated attacks may cause temporary degradation or require traffic filtering.

Backups. Where provided, backups are for disaster recovery and are not guaranteed. Customers are responsible for maintaining their own off‑site backups of world files, saves, and configurations.

Account & Panel Access. You are responsible for maintaining the confidentiality of your credentials and restricting access to your control panel, SFTP/FTP, and API keys. Activity under your account is your responsibility.

Security Updates. We may apply urgent OS, game, or panel updates and perform emergency maintenance without prior notice when required to maintain service integrity.

PROPRIETARY RIGHTS

All Solskera content and materials are protected by applicable intellectual property laws. A person or entity may not copy, modify, distribute, sell, or lease any part of our services or included software without our written consent.

COOKIE POLICY STATEMENT

We use cookies and similar technologies in the client area, knowledgebase, and checkout to enable core functionality (authentication, session management), preferences, and analytics.

Essential cookies are required for the site to function and cannot be disabled. Non‑essential cookies (such as analytics) are used where permitted by law and your preferences.

You can manage cookie preferences via your browser settings. Blocking essential cookies may prevent you from logging in or completing purchases.

GENERAL POLICIES

Acceptable Use. Services may not be used for illegal activity, harassment, doxxing, malware distribution, unauthorized access, or to conduct/solicit DDoS or other attacks. Cheating tools that harm game networks are prohibited.

Content & Mods. You are responsible for the licenses and legality of any content, mods, or workshop items you upload or run. We may remove content that violates rights or laws.

Resource & Fair Use. Plans include shared CPU and network resources. Sustained usage that adversely impacts other customers may be rate‑limited or moved. Dedicated resources are available on higher‑tier offerings.

Maintenance & SLA. Reasonable efforts are made to keep services available. Scheduled maintenance is typically performed during low‑traffic windows. Downtime credits, if any, are outlined in product‑specific terms.

Termination. Solskera may suspend or terminate an account or access to the Services, with or without notice, for violations of these Terms, unlawful or harmful conduct, or failure to pay applicable fees. You may stop using the Services at any time. Termination does not relieve obligations incurred prior to termination.

Disclaimer of Warranties. Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non‑infringement.

Limitation of Liability. To the fullest extent permitted by law, Solskera is not liable for indirect, incidental, special, consequential, or punitive damages. Solskera’s total liability arising from or related to the Services will not exceed the fees paid for the Services in the three (3) months preceding the claim.

Indemnification. You agree to defend, indemnify, and hold harmless Solskera, its affiliates, and employees from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, violation of these Terms, or infringement of third‑party rights.

Governing Law; Venue. These Terms are governed by the laws of the United States and the State of Minnesota, without regard to conflict‑of‑law principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Services shall be state or federal courts located in Hennepin County, Minnesota, and the person or entity consents to the personal jurisdiction of such courts.

Dispute Resolution; Arbitration; Class Action Waiver. Any dispute shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), held in Hennepin County, Minnesota, unless both parties agree otherwise. The person or entity waives the right to participate in class actions or class arbitrations.

Severability; Entire Agreement. If any provision is found unenforceable, the remainder will continue in effect. These Terms, together with applicable policies, constitute the entire agreement between you and Solskera regarding the Services.
